When property is purchased within the Verde Village, it is subject to deed restrictions, known as the Covenants, Conditions and Restrictions or CC&R’s. Compliance with these CC&R’s is outside of, and separate from, membership in the Verde Village Property Owners’ Association, although there has been much confusion about this in social media lately.
These CC&R’s vary depending on what Unit the property is located in. They were written well over 25 years ago and intended to ensure that any construction was done within a consistent set of rules meant to ensure a pleasing appearance within the village. However, they were written at a time when things such as working from home was unheard of and, in fact, there are restrictions in all eight versions of the CC&R’s that prohibit conducting business from property zoned for residential use.
The Board of Directors recently contracted with outside counsel regarding the CC&R’s to see what would be needed to bring them current with today’s realities. What we found was a bit surprising, and we felt it should be shared with you.
The CC&R’s for each Unit will begin to expire as of the 50th anniversary of their inception. Here is a list of those dates:
Unit 1: February 5, 2018
Unit 2: June 25, 2018
Unit 3: June 25, 2020
Unit 4: September 1, 2020
Unit 5: November 1, 2020
Unit 6: February 1, 2021
Unit 7: April 1, 2021
Unit 8: December 7, 2021
As the CC&R’s expire, the Unit in question will still be subject to Yavapai County Planning and Zoning Ordnances, and any other County regulations and ordnances that may be applicable to unincorporated areas of Yavapai County.
Should the Unit wish to extend, rewrite or write a new set of CC&R’s, it would require that the owners of 75% of the lots in that Unit agree to such an action. Again, here are those numbers:
Unit 1: 75% of 206 lots = 155
Unit 2: 75% of 514 lots = 386
Unit 3: 75% of 684 lots = 513
Unit 4: 75% of 433 lots = 325
Unit 5: 75% of 600 lots = 450
Unit 6: 75% of 750 lots = 563
Unit 7: 75% of 623 lots = 468
Unit 8: 75% of 630 lots = 473
These decisions rest solely with you, the property owners. The Board of Directors stands by to answer any questions you might have, however we ask that you speak first with your neighbors and contact us as a group.
